Terms & Conditions

General

These Booking Terms and Conditions herefore form the basis of the contract between Status Florida Villa (Us) and the lead member of the rental party (You).  You, on behalf of all the members of the rental party, accept these terms and conditions by signing the booking form and paying the reservation deposit.  A legal contract between You and Us will become binding on acceptance of the Booking by Us.  You will then become our contact point on behalf of the rental party and will be responsible for all payments in relation to the Booking.  If any of the Terms and Conditions herefore is breached by You (any member of the rental party), We (Solana Disney Villa) reserve the right to terminate the Booking immediately and without refund or compensation. 

This Contract shall be governed by and interpreted in accordance with English law.  In the event of any dispute arising out of or in connection with the rental agreement which can not be settle amiably between the parties, it shall then be determined within an English Court in the English jurisdiction.

Payments

A non-refundable deposit of £125 or $225 per week is required for the Booking.  Bookings which are not in whole weeks are rounded up when working out this non-refundable deposit.  If the Booking is done at less than eight weeks before rental commences, the full rental cost must be paid at the time of the Booking.

The balance of the rental payment is due at least eight weeks before rental commences.  You will be responsible for the payment of the balance amount with or without reminder from us.  If payment is not received by the due date, We reserve the right to cancel the Booking immediately and without any refund or compensation.

A security deposit of £250 or $450 is also required and is payable by You with the balance payment.  This money will be refunded completely after the end of your rental period, providing that no damage has been sustained to the Villa, its contents or facilities.   If additional cleaning is required or items (whether missing, damaged and/or broken) needs replacing, these costs will be set against the security deposit.  If the costs are in excess of the security deposit, You will be responsible to pay Us the excess amount promptly and without any dispute.

Rental Party

It is a legal requirement of the Florida short term rental licensing law that all guests must be identified on the booking form (including infants).  This law states that the Villa can accommodate a maximum of 12 people including infants.

The Villa cannot be sub-let to any other party.  Notice of change to any names in the rental party must be supplied to Us as soon as possible and before entry into the Villa.  We reserve the right to refuse the changes if they are deemed illegal or unacceptable, and without any refund or compensation.

Responsibilities

All guests have, but not limited to, the following responsibilities in relation to this Booking:

§         Ensure each guest has comprehensive travel insurance to include but not limited to medical, lost and damage of belongings, and cancellations.

§         Ensure each guest has a valid passport and entry visa to the United States

§         Smoking is not allowed inside the Villa. You may smoke in the decking area by the swimming pool, provided you take care and dispose of cigarrette butts.  

§         No open flamed fire such as lighted candles is allowed any where in or near the Villa.

§         Pets are not allowed in the Villa at anytime

§         All external doors must be securely locked at all times

§         All doors and windows must be fully locked AND alarm set to on when the Villa is unoccupied

§         All doors and windows are kept shut when the air conditioning is switched on.  Make sure the air conditioning and all equipments including house lighting are switched off when unoccupied

§         Any form of glass items are not allowed in or near the swimming pool area

§         Children should not be allowed to swim unaccompanied

§         Diving in the swimming pool is not allowed

§         Running, jumping, pushing or any form of rough activities along the pool side or any wet area is not allowed.

§         Top up pool and spa/Jacuzzi water as necessary

§         Cover up food and rubbish/garbage to avoid pest and infestation problems

§         Use the free phone call service sensibly.   Note that this service excludes call to premium line numbers and continuous (> 2 hrs) long distance calls.  The phone might be locked unuseable by our service provider if abused in this way.  All charges to unlock and reconnect this service as well as any compensation will be paid for by the guest who is responsible for the lock up.

§         Keep the Games Room Up-And-Over (external) door shut at all times when in use. 

§         To keep the peace and tranquillity in the Villa community, please do not engage in loud and/or disturbing activities.  We do not tolerate unsocial behaviours resulting in complaints.  If this happens guests, which might include the entire rental party, will be asked to leave the Villa immediately without any refund or compensation

§         Must only park in the Villa’s driveway.  A maximum of two cars are allowed.  The games room can be rearranged so that one car can be parked inside.  However, guests are strictly prohibited from using this room as a games room when use as a garage, and that the portable air conditions in this room must be switched off.

§         No commercial vehicle (apart from our agents vehicles) is permitted to be parked either on the driveway or off road next to the Villa.

§         Ensure, especially at the end of the rental period, all utensils, carpets, furnishings, walls, fittings must be left clean and tidy.

§         Notify the management company immediately of any sudden equipment failure so that reasonable action is taken to rectify the situation.

Status Florida Villa responsibilities are as follow:

§         Ensure that the Villa is fully licensed for short-term rentals in Florida

§         Ensure the Villa is registered with the state authorities and is in full compliance with all relevant legislation

§         The Villa must be safe and that it is cleaned before the arrival of our guests

§         Clean the Villa including swimming pool, spa and garden once a week during the rental period

Cancellation

Notice of cancellation by You can only be given in writing with your signature.   If You cancel earlier than 8 weeks before the planned rental date, only the deposit will be lost.  However, if you cancel later than 8 weeks before the planned rental date, all paid rental costs will not be refunded, whether or not we are able to find replacement bookings.

If due to circumstances beyond our control cancellation by Us of the Villa booking becomes necessary for any reason including but not limited to destruction or damage to the property, we will refund all payments made in full and will make every attempt to assist you to book an alternative villa of similar luxury and facilities.  We do not accept liability for any other payment by way of compensation, damage or otherwise including but not limited to refund of airfare, tickets or car hire in relation to such cancellation.

Check-in and Check-out Times

To allow our cleaners sufficient time to clean and prepare the Villa for our next guests, we ask that You check-in or arrive at the Villa no earlier than 4pm on the arrival date.  On check-out or departure date, You must leave the Villa no later than 10am.  Failure to comply with these times might result in extra rental charges at £20/$35 per hour plus any compensation resulted from claims make by the delayed party.  Earlier arrival or later departure can be arranged for your convenience without extra charge if the Villa is not occupied on these dates.

Owner Access

We reserve the right to enter the property at any times to check for damage, for necessary maintenance or in response to complaints from neighbouring renters or residents.  The Villa will require cleaning at least once a week, and the pool and garden may also require routine attention during your visit.  Our cleaners will do everything reasonably possible to ensure that this is done at a reasonable time and does not interrupt your enjoyment of the Villa.

Problems at the Villa

If you need assistance or have any problems in relation to the Villa, its contents or facilities during the rental period, in the first instance, please contact our local management company immediately.  Full contact details will be available at the Villa.  We will not be responsible or deal with any complain no matter how serious if it is not in writing and notify to us with 14 days after the incident date.

Liability

We do not accept any responsibility whatsoever for any loss, damage or injury sustained by any Villa guest from the use of the Villa or any of its contents or facilities.  It is your responsibility to ensure that all guests fully comply with all safety instructions and exercise due care and diligence during the rental period.

We will not be liable for any loss or damage or alterations to the terms of this booking caused by events beyond our control including, but not restricted to, war, civil commotion, flight delays or cancellations, technical difficulties with transportation, alteration or cancellation or schedules by carriers, adverse weather conditions, fire, flood, industrial dispute etc

We will not be liable for any misprint or missing of information either on our website, in the welcome pack, notices and instructions at the Villa or in any of our marketing materials.
